What Is WUCIOA (RCW 64.90) For All?

The Washington Uniform Common Interest Ownership Act (known as WUCIOA) will apply to all communities in its entirety on January 1st, 2028. However some provisions are already applicable to all communities and new provisions will apply as soon as January 1st 2026.

Current Community Association Laws

Currently, Community Associations (Homeowners' Associations, Condominium Associations, Townhomes, etc.) are divided between different statutes:

Horizontal Property Regime Act ("Old Act"), RCW 64.32
Condominium Act ("Condo Act), RCW 64.34
Homeowner Association Act ("HOA Act"), RCW 64.38
Washington Uniform Common Interest Ownership Act ("WUCIOA"), RCW 64.90

Starting January 1st, 2028, RCW 64.32, RCW 64.34, RCW 64.38 will be fully repealed and only RCW 64.90 will be applicable to all communities. However some key provisions are already apply to all communities and new owner protections will be applicable starting January 1st, 2026.

What is WUCIOA?

The Washington Uniform Common Interest Ownership Act, codified as RCW 64.90, is a comprehensive legal framework enacted to modernize and unify the governance of condominiums, homeowners associations (HOAs), cooperatives, and other common interest communities across Washington State.

Originally passed in 2018 and significantly expanded in 2024, WUCIOA’s intent is to promote transparency, accountability, and fairness in community association operations by establishing clear standards for budgeting, meetings, records access, reserve funding, disclosures, and owner rights. Its key provisions include mandatory budget ratification, resale certificate requirements, open board meetings, member voting protocols, and guidelines for the installation of energy-efficient improvements such as electric vehicle chargers and heat pumps.

The ultimate goal of WUCIOA is to ensure consistent, equitable governance across all communities, regardless of size or formation date,while safeguarding homeowner interests and strengthening community engagement.
